The artist may customise any clause marked with the ✎ edit symbol. Clauses without that symbol reflect platform requirements or legal standards that Stoodio recommends keeping unchanged. The artist is solely responsible for the accuracy of any information they add or modify, and for ensuring their customised terms comply with applicable law in their jurisdiction. This document governs only the commercial relationship between the artist and the buyer. The collection and processing of personal data from buyers and visitors is governed exclusively by the Artist Website Privacy Policy and Cookie Policy, which are separate documents not modifiable by the artist.

Scope of this document

These Sales Terms govern the purchase of artworks by buyers from [ARTIST NAME] via this website. They set out the rights and obligations of both the artist (as seller) and the buyer in connection with any sale transaction.

These Sales Terms do not govern the collection or use of personal data from buyers or website visitors. 2. Artworks Available for Purchase

The artworks available for purchase on this website are original works created by [ARTIST NAME], or, where indicated, limited edition prints or multiples produced under the artist's direct supervision and control.

Each artwork listing includes, where applicable: title, year of creation, medium and materials, dimensions, edition information (edition number and total edition size), and sale price. Buyers are encouraged to contact [ARTIST NAME] prior to purchase for any additional information about a specific work.

3. Prices

Shipping costs are not included in the artwork price unless stated otherwise on the listing. Applicable shipping costs will be displayed at checkout before payment is confirmed.

4. How to Purchase

Payment is processed securely by a third-party payment provider (Stripe, PayPal, or another provider as displayed at checkout). 5. Payment

Full payment is required at the time of purchase. No artwork will be prepared for dispatch until payment has been confirmed as received.

6. Title and Risk

Until title passes, the buyer acquires no ownership rights in the artwork and [ARTIST NAME] may recover the artwork if payment is not received in full.

7. Authenticity

All original works sold via this website are created by [ARTIST NAME] and are sold as authentic works by that artist.

For limited edition prints and multiples, each edition is numbered and signed by [ARTIST NAME] unless otherwise stated on the listing.

8. Shipping and Delivery

8.1 Dispatch

8.2 Shipping methods and costs

International buyers are responsible for any import duties, customs charges, or local taxes applicable in their country of delivery. [ARTIST NAME] is not responsible for delays caused by customs procedures.

8.3 Delivery timeframes

8.4 Damage in transit

Artworks are carefully packaged to minimise the risk of damage in transit. If an artwork arrives damaged, the buyer must notify [ARTIST NAME] at [ARTIST CONTACT EMAIL] within [48 hours / 5 business days] of receipt, providing photographs of the damage and the packaging. [ARTIST NAME] will work with the buyer to resolve the matter, which may include replacement (where available), repair, or refund.

9. Returns and Refunds

9.1 Right to cancel (distance selling)

If the buyer is a consumer (an individual purchasing for personal use, not in the course of a business) located in the United Kingdom or European Union, the buyer has the right to cancel their purchase within 14 days of receiving the artwork, without giving a reason, in accordance with the UK Consumer Contracts Regulations 2013 and, where applicable, the EU Consumer Rights Directive (2011/83/EU).

To exercise the right to cancel, the buyer must notify [ARTIST NAME] at [ARTIST CONTACT EMAIL] within the 14-day period. The buyer must return the artwork in its original condition and packaging within 14 days of notifying cancellation. The cost of return shipping is the buyer's responsibility unless the artwork was delivered in error or is faulty.

Refunds will be issued within 14 days of [ARTIST NAME] receiving the returned artwork, using the same payment method as the original transaction.

9.2 Exclusions

The right to cancel does not apply to:

  • Artworks that have been custom-made, personalised, or commissioned specifically for the buyer.
  • Artworks that have been clearly personalised at the buyer's request (for example, a work inscribed or dedicated by the artist to the buyer).

9.3 Faulty or misdescribed works

If an artwork is materially different from its description on the website, or arrives with a defect not caused by transit damage, the buyer is entitled to a full refund or exchange. The buyer should contact [ARTIST NAME] at [ARTIST CONTACT EMAIL] within [14 days] of receipt. [ARTIST NAME] will cover the cost of return shipping in these circumstances.

9.4 Change of mind (outside statutory rights)

10. Intellectual Property

The buyer acquires the physical artwork (or, in the case of a print, a physical or digital edition of the work) and the right to display it privately. The buyer may not reproduce, distribute, publicly display, create derivative works from, or otherwise exploit the artwork or its image for commercial purposes without the prior written consent of [ARTIST NAME].

11. Artist's Resale Right

Buyers who intend to resell works purchased via this website through an auction house, gallery, or dealer are advised to consult applicable regulations regarding resale royalty obligations in their jurisdiction.

12. Limitation of Liability

To the fullest extent permitted by applicable law, [ARTIST NAME]'s liability to the buyer in connection with any sale shall not exceed the price paid by the buyer for the artwork in question.

13. Disputes and Governing Law
